Welcome to Keystone Document Discovery. These Terms of Service (“Terms”) govern your use of our services, including the copying and scanning of trial exhibit binders, eDiscovery services, and other related services. By using our services, you agree to these Terms. Please read them carefully.

1. Services Provided

  • Copying and Scanning Services: High-quality copying and scanning of legal documents, trial exhibit binders, and related materials.
  • eDiscovery Services: Comprehensive eDiscovery solutions, including the collection, processing, review, and production of electronically stored information (ESI) for legal proceedings.
  • Delivery of Digital Copies: Digital files can be delivered via secure means or on physical media such as USB flash drives, hard drives, or DVDs.
  • Optional Encryption: Encryption services for secure handling and transfer of data upon request.

2. Data Handling and Retention

  • Data Deletion: We are committed to protecting your data. All customer data, including digital files, scanned copies, and eDiscovery materials, will be securely deleted from our systems within 30 days after the delivery of your order, unless you request otherwise. This deletion ensures your privacy and data security.
  • Customer Requests: If you require us to retain your data for a longer period, please notify us in writing before the 30-day period elapses. We will comply with such requests according to your instructions and applicable legal requirements.

3. eDiscovery Services

  • Scope of eDiscovery: Our eDiscovery services include the identification, preservation, collection, processing, review, and production of ESI. We work closely with you to ensure that the eDiscovery process is thorough, compliant with legal standards, and tailored to your specific needs.
  • Data Processing: During the eDiscovery process, we may process large volumes of data, including emails, documents, databases, and other electronic files. You acknowledge that the accuracy of the data processed is contingent on the quality and completeness of the data you provide.
  • Confidentiality: We understand the sensitive nature of eDiscovery materials. All data processed during the eDiscovery process is handled with the highest level of confidentiality and security. Access to your data is restricted to authorized personnel who are bound by strict confidentiality agreements.
  • Data Security: We implement industry-standard security measures to protect your data during the eDiscovery process. However, you acknowledge that no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
  • Litigation Holds: If you require a litigation hold, please inform us immediately. We will take all necessary steps to preserve the relevant data. You are responsible for ensuring that we are aware of any legal obligations related to data preservation.

4. Delivery Options

  • Digital Delivery: Files can be delivered electronically through secure file transfer methods.
  • Physical Media Delivery: Upon request, we can deliver your data on a USB flash drive, hard drive, or DVD. Additional charges may apply for these physical media, and you will be informed of the costs beforehand.
  • Encryption: You may request that your data be encrypted before delivery. We offer industry-standard encryption to ensure that your information remains secure during transfer.

5. Customer Responsibilities

  • Provide Accurate Information: Ensure that all information and data you provide to us is accurate and complete to the best of your knowledge.
  • Compliance: Comply with all applicable laws and regulations related to the materials you submit for copying, scanning, and eDiscovery services.
  • Payment: Pay all fees and charges associated with your order as detailed in the invoice provided to you.

6. Limitation of Liability

  • Service Accuracy: While we strive to provide accurate and high-quality services, Keystone Document Discovery does not guarantee that the services will be error-free. In the event of an error, our liability is limited to re-performing the service or refunding the cost of the service, at our discretion.
  • Data Security: We take reasonable measures to protect your data; however, we cannot guarantee the absolute security of electronic data during transmission or storage. Keystone Document Discovery is not liable for any loss, unauthorized access, or misuse of data during or after the service process.

7. Confidentiality

We understand the sensitive nature of the documents and data you provide. Keystone Document Discovery maintains strict confidentiality practices to ensure that your information is handled with the highest level of security and privacy. All employees and third-party service providers who may have access to your data are bound by confidentiality agreements.

8. Termination

Keystone Document Discovery reserves the right to terminate or suspend services to any customer who violates these Terms or engages in activities that are unlawful or detrimental to our company or other customers.

9. Changes to the Terms

We may update these Terms from time to time. Any changes will be posted on this page, and your continued use of our services after such changes will constitute your acceptance of the new Terms.
